“On behalf of East Whiteland United, a group of landowners and citizens impacted by the Sentinel Green Fig II, LLC’s (“Sentinel”) development of the former Foote Mineral CERCLA Site (“Project”), undersigned counsel is hereby serving this letter to provide to you official notice pursuant to Section 617 of the Pennsylvania Municipalities Code of the group’s intention to sue the East Whiteland Township and the Board of Supervisors (the “Township”) and Sentinel for violations of the Township ordinances and the terms and conditions of the Final Plan Approval granted by the Township for the Project.”
