chester county at risk: historic birchrunville

I love being in Chester County.  Before I was a resident, anytime anyone wanted to take a leisurely drive and explore, I was all for it.

Birchrunville was one of those places.  Quiet and charming, consisting of small country roads.  Farms. Horses, as you can actually still ride your horse on the road which you won’t be doing if this development happens. Great old country architecture and some incredible old houses.  The real deal of charm.

It is NOT a place where developers should come in with their Emperor’s New Clothes grand plans for supersizing a small hamlet.  The residents should not allow it, and quite frankly, any elected or appointed official who likes a plan like this should be voted out as soon as possible.

We are, after all, talking about West Vincent Township.  And for West Vincent Township to go from needing/wanting eminent domain for private gain at Christmastime 2011 to this plan now, well it is so very Lower Merion Township that I can’t stand it.  And I can tell you how the story turns out: it doesn’t.

Once upon a time Lower Merion made a bid for eminent domain for private gain.  Then they put people through the pain of grand redevelopment plans.  All people wanted was a train station.  What they got was heartache, headaches, and nothing. Well nothing except a lot of money spent on plans, plans, and more plans.  A lot of the money spent was part of $6 million dollars that your Congressman Jim Gerlach got so Ardmore could have a new train station/transit center.  So much of that money has been squandered that I just don’t get why Jim Gerlach hasn’t pulled the money back yet.  But maybe he will and it will serve Lower Merion right.

And don’t let Supervisor David Brown tell you he had no idea of what went on in Lower Merion.  He was too entrenched in the politics for too many years not to know.  Via his own online political resume you can see: Republican Committee of Lower Merion & Narberth Committeeman 1976 – 1990, Counsel to Committee 1990 – 2004, Member Executive Committee 1990 – 2004, Former Solicitor to Montgomery County Controller,Gladwyne Civic Association, Former Director, Former Vice President.

See this synopsis from The Castle Coalition in Washington DC where I will highlight some dates in particular (although I encourage you to read it all):

….a letter in February 2004 informing him that Lower Merion Township had targeted his property and those of his neighbors for eminent domain acquisitions, he was devastated and uncertain about how to proceed….

In September 2004, the Township hired an independent consulting firm to study Ardmore and assess the extent to which economic redevelopment really required condemning their properties, as local officials contended. The Urban Land Institute, an outside organization that specializes in land use and has no financial connection to the business owners or the Township, conducted a comprehensive study of the downtown business district slated for demolition, and strongly urged against the plans proposed by the Planning Commission. Instead, the Institute submitted a number of alternative approaches to the Township, all of which protect property rights and promise the same benefits the municipality sought without condemning the Ardmore properties.[3]

“We kept coming up with alternative plans, but the Township kept ignoring us,” Mahan said.

In December 2004, the Lower Merion Board of Commissioners overwhelmingly approved the most destructive redevelopment option of all the plans submitted for its consideration. The proposal submitted by Hillier Architects called for the demolition of Ardmore’s entire historic district—even though Hillier simultaneously concluded that all of the buildings were in restorable condition…….the Save Ardmore Coalition continued fighting, attending all civic meetings, speaking against the proposal and especially against the abuse of eminent domain, and pursuing practically every grassroots avenue available.

“We’d march to the meetings, carrying signs and making statements. We’d have 300 people on our side, and 100 of them spoke out against the Hillier plan,” he said. “We just kept gaining momentum and the SAC kept growing and growing.”

 

These plans fermented for years prior to 2004 being the year eminent domain came full out in the public eye.  And during that time there were commissioners on the board in favor of this, including one Ken Davis and there is no way David Brown did not know him. Ken Davis represented parts of Gladwyne and was a fellow Republican and member of Gladwyne Civic.  Trust me, not that big of a sphere.

And if David Brown is for this development of Brichrunville, then he should go as soon as his term is up, but if Ken Miller and Clare Quinn are up first, vote them out.  If you do not change the face of who governs you in West Vincent, you will not achieve what you need to achieve.  I know because because I was part of a group who did it.   We flipped five of the seven commissioner seats up in elections, and the people who came in had adopted our group’s mission to defeat eminent domain for private gain.  You see, we endorsed no one.  We had a position: no eminent domain.

But after we defeated eminent domain and the fractured community came together once again, we were faced with re-development plans.  We should have said no.

And if you don’t believe how the land can be raped and pillaged by development that is not truly necessary, take a ride down King and check out the mega mess in Malvern.  They got sold a New Urbanism Fairy Tale and they will rue the day when all is said and done is my prediction.  I am not anti-progress, but I am anti-supersizing it on the theory of build it and they will come because it is not true.  All this hoo ha over transit oriented development.  It’s suburbia, people will always drive, always have cars. Duh.

Malvern got themselves a nice new train station, and if this current development being built was much smaller and in a scale actually in keeping with a very small town?  Well we might be having a different conversation.  Instead, West Vincent, you are being presented with cautionary tales.

But residents, I and others can talk about it, offer opinions from the sidelines and write articles, but you have to pull a real We The People and rise up with pitch forks if necessary.  You have to not just talk about it but actually fight.  Accept it will get nasty and dirty tricks will abound.  To me, it should all be important enough to preserve your way of life. As well as your property values.  (C’mon you think you are going to find it easy to sell a property if West Vincent keeps up indefinately with the West Vincent of it all?)

Rise up, support folks like BirchrunvillePeople who are trying to do good.  And if you feel your government is not quite right and not quite ethical, hello it is a MAJOR election year.  Your congressman needs more than checks from fat cats to survive, he needs votes.  Get him to come around an you show him what you are trying to preserve.   Go to the state.  Surely the Attorney General’s office and ethics board are there for a reason?

But you have to do it for yourselves.    This video like the one up top is awesome.  Kudos to whomever did that.  It literally shows people what you are talking about.

None of this will be easy, but you defeated eminent domain for the time being, so keep on keeping on and save Birchrunville too.  After all, you may or may not realize that developers as much as they love to destroy small towns, also love to recreate them.  You have the real deal.  Preserve your way of life.

And don’t be swayed by “oh but look we can improve our roads.”  Beg to differ.  If your roadmaster actually took the proper care of the roads you would be fine.  But what will happen with road improvements if development occurs?  It will look good for a while because it is new and then it will be back to mainteance business as usual so what is the difference?

This historic school house could be easily sold and preserved from what the video says.  It is YOUR community.  Make that happen.  YOU are the taxpayers.  YOU are the voters.

Once a way of life is destroyed, it is gone.

west vincent on the peoples’ radar again: rising up about birchrunville

I haven’t had much to say lately about West Vincent.  First of all, nothing is changing, just more of the same old same old….including everyone but the cows at Ken Miller’s farm are being told they are the fine feathered friend Chickenman.  That gets old, who cares,  and besides they gave up burning witches at the stake centuries ago, right?

What doesn’t get old in West Vincent, apparently, are mysterious acts of retribution. Yeah, everyone knows it goes on and they are not paranoid delusions of residents. Stuff like that happens every day, and not just in West Vincent.

But West Vincent hasn’t been Mayberry Sleepy…. and there still seems to be stuff going on “on the down low”.

Chickenman’s e-mail the other day made me wonder if it was time for an update.  He wanted people to read an article in The Daily Local about proposed development of the old township building property, which is apparently a historic school house.

WEST VINCENT — Residents are concerned about office buildings proposed in Birchrunville, and they want township supervisors to reject the plans as inappropriate for their historic village center.

The applicant for the Birch Run Village plan seeks to construct three two-story office buildings, each of about 2,500 square feet, on a total of 2.5 acres.

 The property is at the corner of Flowering Springs Road and School House Lane. The school house on the adjoining parcel was built in 1833 and was formerly used as the township’s administrative building.

 According to Supervisor Clare Quinn, the zoning for the area is mixed use, which allows small commercial development.

Suzanne M. Roth, who sits on the township’s Environmental Advisory Committee, hopes more residents realize what the proposal means.

“We just really want to make sure that people understand the amount of development that’s being proposed for this property, the impact that it’s going to have on all of our lives,” said Roth. “This keeps changing, but at the moment it looks like there will be (three) two-story buildings.”

According to Township Manager Jim Wendlegass, Birch Run Village Leasing LLC originally submitted a land-development application in late 2004. That was denied, he said, and a new plan was submitted last year.

The township’s Planning Commission advised supervisors to reject waivers sought by the developers for the project….“This is an historic village with roads to match,” said Roth. “If the property is developed as planned for each parking space allotted, there will be eight car trips anticipated to travel our roads.”

That would mean about 256 to 270 more cars passing her house  daily or turning around somewhere in the village to enter the office complex, Roth said.

“Township police cannot enforce the 15 mph speed limit on the lower portion of School House Lane now,” she said.

 Ethan Schofield, whose property also neighbors the site, hopes that more residents will become aware about the issues at hand…Kenny Carroll, a resident of the township since 1973, said he was specifically concerned with impacts on the environment. “The Birchrun Creek, an exceptional value creek, will be seriously impacted by this development,” said Carroll…According to Carroll, another issue is the development’s impact on the schoolhouse building. “This building is an historical building,” said Carroll.

….Roth and other residents have put together a website, http://www.birchrunvillepeople.com/, with more information about their concerns on the project, hoping to inform the township and community members about these and other issues.

Clare Quinn?  How can anyone believe a thing that comes out of her mouth?  Isn’t she Chester County’s reigning queen of eminent domain is a good thing?  And well, don’t all the residents pay her health insurance via tax dollars, making her right up there with sucking off the proverbial public teat, yes?

In general, where is the need for this development?  Did residents request it?  Are there businesses lined up with signed leases waiting to move in?  How does this work? This isn’t just a suburb, it’s the country, and one of the largest problems with Chester County as beautiful as it is, are these odd business developments that never look exactly full.  Who decided there was an actual need, or is this a build it and they will come scenario? I don’t understand.

Malvern is already learning how their development that will be super-sized and traffic clogging will impact the borough economically.  Suffice it to say, it will not be the cash cow officials thought it would be.  And lordy it has taken David Della Porta long enough to get one of his New Urbanism Fantasy Plans through.  He’s a nice man, I have met him, but I have heard him chirp this all before – it’s just with the Borough of Malvern he finally found his perfect rubes.  He said at a ground breaking after the fact:

“What I mean by that is, the first urban-esque, mixed-use, transit-oriented development,” he said. “There’s really nothing in Philadelphia suburbs like this, where you have retail-residential involved in a great existing place that already has a beautiful little town, the services and the train station within walking distance.”

Urban-esque?  Hello, why do people move to the suburbs?  Why do people move to the country?  Is it so they can eventually feel the urban of it all they moved away from?  Call me crazy, but I don’t think so.

So West Vincent residents, lovers of Birchrunville, what say you?  Is this what you want?  It seems to me that a lot of different voices are saying “no”, aren’t there?

The problem is, this dopey plan will go through unless fought tooth and nail.  And I hope people get political.  Let your Congressman up for re-election know how you feel too.  Hasn’t he received a tidy sum of donations from power brokers and decision makers in West Vincent?  Donations are nice, but votes get an elected official where they need to go, so always let them know how you feel about local issues even if they are not directly involved.  Especially during a big election year.

Now, let’s also use this as a reminder as to why West Vincent needs term limits and new supervisors.

Good for these residents for stepping up and having a say!   But it is West Vincent, so who knows how it will end up. All I know is little country roads are just that: little.  And you only get so many chances to keep water sources clean and once an environment is gone, etc., it’s gone.

It’s a damn shame that the politicians in West Vincent and the taxpayer-funded staff do not really get the value of the charm of this area that will disappear once they turn it into Little Eagle.  I can’t wait for the CVS with fake Victorian gables.

be glad you live a little off the main line…

…I know I am.  

Sure, every area has issues.  No local government is perfect, and yes, there is always something to complain  about, but seriously?  I moved out of a township that prided itself on being “first class”, yet it in essence required an act of Congress to accomplish something as basic as filling a pothole.

Yes, Lower Merion Township.  The Magic Kingdom as it is known (sarcastically) in some circles, isn’t what she used to be.  You have a political majority that believes they know better than everyone, and as a resident you feel as if you work to support the township.

Where do a lot of these negative feelings stem from?  A lot of them have to do with all the crazy infill development plans and the fact that it has been over 30 years since Lower Merion had a completed Comprehensive Plan update.  Some land planner told me once that as per the Municipalities Planning Code in PA municipalities are supposed to do this every couple of years.

When I used to wake up in Lower Merion, although a high rent district, the cacophony of sound that assaulted my senses on a daily basis was quite urban.  Construction and other noises often way too early.   Here when I wake up, I hear birds.  You have NO idea how marvelous a sound that is unless you have experienced the other.

Development plans in Lower Merion, suit the developers, not the residents.  For example, the development begun in my old neighborhood by a wannabe developer, architect Tom Hall, and then turned over to Cornell builders was shoe-horning in thirteen townhouses in barely over an acre.  But the houses are “green” and you can spit at The Haverford School, which was perhaps the most uncaring neighbor in my neighborhood.   You have no idea what it is like to live with an institution as a neighbor in close quarters.  We existed to be their overflow parking lot and speed thru cell phone mommy/nanny zone.  The nicest thing about that school are some of my friends’ sons.

In Ardmore, the neighboring town, mostly in Lower Merion, for years not so long ago, small business owners had to fight eminent domain for private gain.  Ardmore residents and business owners are still suffering because although no one can spend money like Lower Merion Township, they still can’t get the Ardmore Redevelopment Plan off the ground.  Of course, many feel, that those on township staff who put forth the infamous plans A & B that contained eminent domain for private gain for years should have just been removed from their jobs.  But they stayed and the six million dollars  that a couple of commissioners went to Washington DC many years ago to get has basically been frittered away, and while places like Malvern and Wayne have a new train station, all Lower Merion has are plans.

Also in Lower Merion, there is crazy zoning being planned for around City Avenue.  So if you think it’s fun now when you get caught in traffic around there, just wait.

Lower Merion loves infill development plans.  The more congested the better.  When I was a child growing up there, like I do now here in Chester County, then I also heard birds and nature as my waking sounds.  It is so much less stressful to hear birds versus construction.

Radnor is not so problematic since they got a new Township Manager and some new commissioners.  Of course, their current president, Bill Spingler is more like old school Delco politics and we’ll leave it at that….hopefully he won’t be president too long.  But Radnor’s new manager,  Bob Zienkowski, as opposed to the old one who made headlines and got relieved of his duties (Dave Bashore), is an accessible advocate for his residents.  It makes a huge difference.  Which is why I am hopeful that Radnor residents will be heard fairly as Villanova attempts to supersize the university (read about Villanova’s expansion plans here ).  It won’t be easy since one commissioner has had to recuse herself, and given Bill Spingler’s cozy personal relationship with the attorney on this project, should this in fact be the commissioner who recuses? After all sometimes isn’t it hard to feel secure around a career politician like Spingler, who offered once upon a time to write a reccomendation letter for the manager the township fired (Dave Bashore)?

One thing that bears watching in Radnor are residents taking up their proverbial pitch forks against storm water issues in North Wayne. (Check out this YouTube from a recent meeting.) What cracks me up here is the woman with dark hair and pony tail.  She wants to sue, sue, sue and all the storm water issues stem from AT&T in Wayne and so on.  While the storm water issues are indeed large and increasingly problematic, truthfully they don’t even realize how people have been working for years on this.  She isn’t breaking new ground so to speak.

In February of 2009, a situation created by the railroad in North Wayne bugged me enough that I wrote an editorial for Main Line Media News about it. The end result was, a Septa engineer high on the food chain contacted me, and without even having to deal with Radnor’s old regime, they actually built some storm water management into the station makeover in Wayne.

It’s not perfect, but better than it used to be.

And this woman who did the presentation at the Radnor commissioners’ meeting (Channel 30 on FiOs FYI)  and a neighbor who says she lives next to a field and the Gulph Creek (wonder if she’s the one who built an addition to a carriage house where the outside door in the rear basically looks like if you open it the creek can just come on in?) who are in this meeting tape, well I get why they are upset, as I have seen first hand the flooding in North Wayne, but as they rant and rail against Radnor, they also need to consider a neighboring municipality.

Ahhh, there is some Chester County of it all in this post, isn’t there?

I am talking about Tredyffrin.  Tredyffrin is upstream on the Gulph Creek from this flood zone in Radnor.   Now Tredyffrin is also in the paper this week talking about some focus group and needing storm water solutions. Fabulous!  However, while the article talks about the need to make sure the storm water stuff is tough enough when it comes to Joe Duckworth’s plans for the Richter tract, nowhere have I seen Tredyffrin talk about the trickle down effect of their prior poor planning in neighboring municipalities.  I am talking in part about Church of the Savior in Tredyffrin.    A lot of issues occur UPstream.  Just check out this document I found from 2000 about storm water.

I guess from the Church of the Savior’s perspective and Tredyffrin’s it is holier to flood your neighbors?  Now granted, I find Church of the Savior to be in the category of religiously creepy, so some could say I have a bias, but Tredyffrin to me always seems a little kooky on the development front and in some other areas.  And if they can’t see it from the township building windows in Tredyffrin, more the better.  Just look at how long it took Tredyffrin to deal with things like off campus student housing.  After all, they couldn’t see historic Mt. Pleasant from the Township Building, could they?

I guess what I am saying is, I have seen and lived what poor development and land planning causes communities (along with the politcs of political favoritism and one party rule run amok), so maybe once in a while, I might point them out.  After all, would you rather listen to birds or bulldozers? Wouldn’t you rather hear about politicians and officials that care about their communities and not just during election cycles?

sharing summer recipes: couscous and cornbread

Yes, I am one of those crazy people who cooks even when it is hot.  I have two dead simple recipes to share with my readers today.  They are not necessarily to be served together, I just happened to be fiddling after gardening.

One is a summer salad with Israeli Couscous, and the second is my spin on cornbread.  Cornbread to me is summer and fall.

Cornbread

Oven pre-heated to 425 degrees.

  • dash of ground ginger
  • dash of cinnamon
  • 1 3/4 cup cornmeal
  • 1/2 cup sugar (white)
  • 3/4 cup flour (I use organic all-purpose)
  • 1 teaspoon of salt (if you use sea salt, make it a scant teaspoon)
  • 1 tablespoon baking powder
  • 1 1/2 cups milk (I used 2 percent today, but anything except skim will work)
  • 4 tablespoons buttermilk powder
  • 1 egg
  • 4 or 5 tablespoons of butter
  • turbinado sugar
  • 1 teaspoon good vanilla extract

Grease and flour a loaf pan.

Mix all the “wet” ingredients together.  You can do it with a whisk.  I do add the melted butter slowly and last into the wet.  You don’t want to cook your egg, after all.

Combine all the dry ingredients and whisk into the wet ingredients.  Pour in your prepared pan and top the batter with a dusting of turbinado sugar.

Pop into your pre-heated oven and  cook about 25 minutes.  Today I cooked it a couple of minutes more, other times a couple of minutes less – depends on the oven.  When the cornbread is slightly brown on top, maybe a couple of cracks on the top and a skewer or knife comes out clean, the bread is finished.  Take it out, let it cool, remove from pan.

Easy and delicious.

This bread is yummy plain, with butter, with jams or preserves, or honey.  I like cornbread with honey.  Right now the honey I have is from right here in West Chester – Carmen B’s.

Summer Salad With Israeli Couscous 

 

  • 1 cup Israeli Couscous
  • Spring onions
  • Parsley (fresh flat leaf Italian – I grow it in my garden)
  • Mint (I grow peppermint and curly mint which is a spearmint)
  • 5 or 6 ounces of crumbled Queso Fresco
  • Jayshree Kosher Salt Garden Seasoning (from Florida, their stuff is terrific)
  • olive oil
  • wine vinegar
  • one fresh lemon, juiced
  • fresh radishes
  • pine nuts (optional)
  • salt, pepper to taste
  • garlic powder

Boil the dry Israeli Couscous in about 3 cups of water according to directions on package of whatever brand you buy (around 12 minutes.)  Drain it and shock it with a quick dash of cold water and toss into a bowl.  Israeli Couscous is larger, and looks like little wheat colored pearls.  You can’t substitute regular couscous for this recipe.  It is specifically designed for the Israeli Couscous.

Chop up a few spring onions (or a bunch of scallions), one or two tomatoes, small bunch of Italian flat leaf parsley, small bunch of fresh mint (you CAN’T substitute dried mint, it will taste gross, so don’t even try), fresh radishes.  Season with Jayshree Kosher Salt Garden Seasoning and fresh ground pepper OR Season with regular salt and pepper. The Jayshree Kosher Salt Garden Seasoning is well worth ordering, or Jane’s Crazy Mixed Up Salt would work too.  Not Lowry’s Seasoned Salt – ick.  Plain salt and pepper might be too bland, but it is entirely up to you.

Toss ingredients lightly and create a simple dressing from the lemon juice, vinegar, olive oil, salt, pepper, garlic.  Whisk the vinaigrette together and pour over salad mixture.   Add crumbled Queso and pine nuts if you so choose.  Toss again and refrigerate.

Easy and delicious.

All the veggies I put in my summer salad with Israeli Couscous today came from the East Goshen Farmers Market.  I would love to share recipes with the market, but apparently, I am too different a person for  the market manager to handle, or I am not politically correct enough, or both.  She had contacted me , wanting to link my blog to the EGFM blog, but then changed her mind.  I was fine with that (and felt bad at the time that she was obviously so uncomfortable having to tell me “oops”).  You see, Birchrun Hills Farms is a producer at this market, I am not changing my mind on how I feel about Farmer-Supervisor Miller and his part in the attempted eminent domain for private gain of Ludwig’s Corner Horse Show Grounds, or the dubious shenanigans in West Vincent.  This is why yesterday, when I had a lunch meeting at White Dog Cafe in Wayne, I passed over a couple of luncheon dishes that were advertised as being made with Birchrun Hills Farm products.

I do however, love the East Goshen Farmers Market even if Madam Market was so impossibly rude last week to me it was embarrassing and hurtful at the same time.  Which given her perky PTA mom persona the rest of the time I have seen her (which is only at the market), was somewhat shocking. It was last week’s behavior that has made me mention the drama a second and last time on this blog.

I am new to this community, so a lot of people are getting to know me.  I totally get that.  But I believe in being active and helpful in one’s community (paying things forward), and last week the EGFM said they were looking for input on gluten-free bakeries and products.  So I stopped to give feedback.  The conversation kind of  came to a screeching halt when she snapped at me how she was a nutritionist.  I am a breast cancer survivor, but I don’t go around snapping that at people when they talk about the disease and possibly use incorrect buzz words and such.  And if I am working on a community event and someone is kind enough  to offer feedback when I solicit it, I am always glad to listen.  After all, you never know where the next great idea will come from.  And well, heck, I know people who have started these farm markets and hired bakeries in this area for organic and gluten free.  I also have friends who live utterly gluten free lives and have to bake on their own because the variety of what they find at gluten free bakeries doesn’t suit their allergies.

Whatever.

I don’t need this gal as a BFF (and since I am blogging about it, a precisely made voodoo doll may be in the process of being crafted or the Welcome Wagon might run me over, I simply don’t know), but I will tell you what, being a newcomer into an area versus being part of the established community has shown me again why you shouldn’t judge before you get to know someone.  Live and let live, and her loss.   I will never be rude to this person, and I will be happy to support the market because it is truly fabulous and with the exception of one farm, full of wonderful vendors.  In that regard she has done a marvelous job.  She can’t help the rest of it.  Just her nature.

To the rest of you, my readers and the people I am meeting here and there as I settle into Chester County, thank you for the warm and friendly welcome.  I look forward to sharing more with you on this blog as the spirit moves me.

east goshen farmers market is today!

Yay!  The farmers’ market is this afternoon in East Goshen Park.  I encourage all my readers to support local farmers whenever possible.

Yes, some of the farmers here are from Lancaster and Berks counties, but you are still supporting Pennsylvania agriculture.   I will admit however, that I am disappointed that they don’t have more local Chester County farmers like Farmer Bob from Sugartown Strawberries represented at the market.

And once again, I can and will boycott one purveyor at East Goshen Farmers Market – Birchrun Hills Farm, which is owned by West Vincent Supervisor and lover of Eminent Domain Ken Miller.  Maybe if he hadn’t tried to make the Ludwig’s Corner Horse Show Grounds disappear and hadn’t done a lot of other skunk worthy things, I wouldn’t be so tough on his farm.   But you don’t have to take my word for it – check out Chickenman or aswestvincentturns on You Tube – Even The Daily Salvo has picked up on the manure stench of West Vincent.

The East Goshen Farmers Market wants to know what we make with our goodies gleaned from the market.  From last week’s bounty I made a Rhubarb-Strawberry Crisp.  Extra yummy due to a touch of tamarind nectar and a dash of cardamom.

stop eminent domain abuse NOW! urge support and passage of H.R. 1433, the Private Property Rights Protection Act

I cut my activism teeth on fighting eminent domain for private gain in Ardmore, PA as part of  The Save Ardmore Coalition and with the help of the utterly fabulous Institute for Justice in Washington, DC.

My fellow Save Ardmore Coalition members and myself went to Washington and other places to fight side by side with people like Susette Kelo for legislation against eminent domain abuse.  Many of us gave testimony at the time on H.R. 4128. We introduced the author of H.R. 4128, now author of H.R. 1433 James Sensenbrenner to Ardmore to check it all out.

H.R. 4128 got buried, but has been resurrected today as H.R. 1433, the Private Property Rights Protection Act.

H.R. 1433, the Private Property Rights Protection Act, will likely be considered by the House of Representatives this week.  It was reported out of the House Judiciary Committee earlier this month.  It is critical that you contact your representatives TODAY and tell them to vote for H.R. 1433.  You may remember that this bill passed the House of Representatives overwhelmingly in 2005 by a vote of 376 – 38, but has been stonewalled in the Senate since.

This reform is long overdue.  H.R. 1433 will strip any municipality that abuses eminent domain of federal economic development funds for two years.  You can read the text of the bill here.  It’s time that Congress stop being complicit in the abuse of eminent domain.

WALSH: Congress can halt eminent domain abuse Politicians must be stopped from using law to reward developer friends

When the U.S. Supreme Court rules, more often than not, that settles the matter.
But not in the case of Kelov. City of NewLondon, where the court sparked a revolt that quickly flared across more than three dozen states. The decision, handed down in 2005, told cities across the country to feel free to take away homes and businesses from property owners and give them to wealthy developers, as long as cities promise they think new developments might generate more tax dollars or jobs, with an emphasis on “think” and “might.”
There is no appeal of Supreme Court decisions and changing the Constitution is hard, but that didn’t stop states from setting more protective standards for their own property owners. Since Kelo, 44 states have enacted laws restricting the power of eminent domain to varying degrees, and more protections are being added. Virginia’s legislature is close to passing expanded protections.
Despite the differences in the reform efforts, the message remains the same: You got it wrong, Supreme Court. Now the nationwide revolt has come to Congress, finally allowing the federal government to join the effort to stop eminent domain abuse.
The power of eminent domain is supposed to be for “public use” so government can build things like roads and schools. Local governments essentially can force homeowners and business owners to sell their land, often at cut-rate prices, so essential services can be built. But starting with the wildly unsuccessful urban renewal efforts of the 1940s and 1950s, “public use” has been stretched to mean anything that possibly could benefit the public, not limited to what the public might actually share in using – shopping malls, fancy housing developments and office towers that could pay those local governments more in property taxes.
It has been demonstrated time and again that eminent domain is routinely used to wipe out black, Hispanic and poorer communities, with less political capital and influence, in favor of developers’ grand plans.
It also has been demonstrated that restrictions on eminent domain in no way inhibit economic growth, as the beneficiaries of eminent domain abuse would like you to believe. Development will continue to happen every day, as it always has, through private negotiation – not government force.
In fact, prohibitions on eminent domain abuse instill confidence in investments, leading to even stronger economic growth.
Groups across the philosophical spectrum have recognized the need to limit this abuse of power to protect those who are defenseless against the seemingly unstoppable alliance of powerful, deep-pocketed developers and their politician friends. The diverse coalition has included the National Association for the Advancement of Colored People, the League of United Latin American Citizens, the National Federation of Independent Business and the Farm Bureau. It’s safe to say that the coalition also includes more than 80 percent of Americans, as demonstrated poll after poll taken after Kelo.
Despite the evidence that Americans are united against the misuse of eminent domain, Congress has yet to to take even a modest step. A bipartisan bill, H.R. 1433, making its way through the House would strip a city of federal economic development funding for two years if the city takes private property to give to someone else for their private use. Cities that want to keep their funding will have to be more circumspect in using eminent domain.
This bill undoubtedly will pass the House as it did in 2005, and likely will get stalled in the Senate Judiciary Committee, headed by Sen. Patrick J. Leahy, Vermont Democrat, where it has gone to die in years past.
It is tragic because this is exactly the kind of centrist reform – uniting minority advocates and small-business interests – where Republicans and Democrats should be able to work together.
