Soooo. This is just a funny little post about wondering if Jerry Pyne is East Whiteland‘s shadow cabinet? I am just asking a question. I am not asserting that by design or anything else. It’s just he seems to insert himself often doesn’t he?

So he has an interesting history. He is now the past vice chair of the Chester County Democratic Committee. it’s actually embarrassing for them that he still shows up when you do a Google search as being Vice Chair because the current Vice Chair is Michelle Smith. and truly that is progress. I don’t always agree with her, but I know she does her best and does her homework and has honor. That is also not saying I have anything to do with this because really my opinion doesn’t matter to them. It’s just an opinion.

Anywhoo, Jerry reared his head and sometimes ruddy complexion when East Whiteland residents were gathering signatures to get the question on the ballot of should East Whiteland Township go to five supervisors.

See there’s Gerry directing opinion traffic or trying to.

Jerry likes to mansplain from what I’m told, but he was practically rabid about this not making the fall ballot wasn’t he? And I am sure he is working feverishly to make sure people don’t vote for this yes?

I never actually realized until this morning that he lives in East Whiteland. I thought he lived over the border in Charlestown for some reason but I guess that’s where the other crazy Jerry lives who is the Republican? It’s easy to get them mixed up because they are a type and there’s one from each party in such close proximity to one another right?

Jerry is a committee person for the Great Valley Democrats. His patch is Peoples Light and he is in the first precinct.

This morning, I was chatting with a friend who is a prodigious reader of meeting minutes of multiple municipalities. Truly a research marvel. So she says to me, do you know who your vacancy board person is in your township? And I said no, why?

And there he is Mr. Vacancy Board 2026! I wonder if he has a pretty sash like a prom queen or beauty pageant winner?

Anyway, what does that mean for the rest of us mere mortals ? Simple. If someone resigns or is removed from office or takes a leave of absence or is incapacitated in any manner he’s the guy that gets called up for tied votes. He’s a vote tie breaker.

Legally, however, he cannot vote himself to be a more permanent supervisor of the board in a situation. The purpose of this position is in part to decide upon a replacement Supervisor should a Supervisor position become vacant. It’s kind of important and people often overlook this spot in township government, myself included. honestly I had forgotten about the position.

So he doesn’t want five supervisors as he loses his power right? He doesn’t want five supervisors because he loves data centers doesn’t he? I mean, shall we recall that email that recently surfaced in a voluminous right to know?

Now the backup generation they were talking about at the time if I’m not mistaken, was the failed attempt at getting a hydrogen hub immediately over the township borders into West Whiteland with samey same developer yes?

So I have a hypothesis and I’m going to ask another question. Does Jerry Pyne want to be a supervisor eventually in East Whiteland? This is easy way to get noticed via the back door if you are like the vacancy board person or appointed by the vacancy board because someone steps down or leaves or whatever?

That snake is not too subtle in this patch of grass IMHO so people need to keep an eye on him and this is yet another reason why we need to vote for five supervisors on the fall ballot.

At this evening’s meeting I learned you were not a dog guy (Great Valley Pet Hotel situation) so maybe you would prefer a ferret cottage?

This evening you were quite frankly a dickhead to the residents who elected you. Even I voted for you, but now wish I had not.

Our perception of you is you seem to think your role besides being a data center apologist is to be some sort of municipal bouncer? The do as I say not as I do manners police?

You did a very public interview with NBC10 once upon a time. That’s why I voted for you as did many others. How are you that person?

Well East Whiteland something else near Malvern Hunt and I am guessing not too far from West Whiteland? It looks like a dump East Whiteland and aren’t those days over? If you are storing things, wouldn’t they be properly housed?

With respect, how much time does East Whiteland spend back there to even know what is happening? Are residents right there wrong?

Residents over near there tell me the area is massive and the property record indicates 61 acres.. Residents report trails are kind of obliterated and overgrown? Residents say it is like a giant dumping ground, which is why a police report was filed?

What does Chester County think or know about this? Aren’t the trails supposed to be interconnected?

If dumping is happening WHO IS DOING IT? Are there trail cams etc?

Come on East Whiteland, it’s bad enough residents of Malvern Hunt etc are already living in fear of that blasted data center……right?

I begin with a stop work order issued today at 4 PM against Sentinel Green Fig re: Data Center in East Whiteland. (Screenshot above.)

Next is a little ditty “explaining” a few things including East Whiteland saying on the record they did not sign NDAs with these data center people. I am glad to hear this.

Then I got this email from today:

In case you can’t read, here is the verbiage verbatim:

Subject: Data Center Project | Request for Immediate Review of Permits

Dear East Whiteland Board of Supervisors, 

I’m writing to follow up on the comments I made at the Board of Supervisors meeting on Wednesday, August 19 regarding the permits issued for the proposed data center project.

I am requesting an immediate review of Permit #B-2026-221 and any related permits issued for the 2024 approved Land Development Plan (the “2024 Plan”).

It is my understanding that this Permit should not have been issued without a commitment letter from Aqua specific to the 2024 Plan. It is also my understanding that the Township has not received that commitment letter. If Aqua has provided the required commitment letter, please share a copy with me. If the Township has not received it, I am requesting that the Township take immediate action to suspend or revoke the Permit until all requirements for its issuance have been satisfied.

I am also attaching documents received from the EPA through a Right-to-Know request that raise an additional concern. The documents appear to show that the developer/applicant submitted information in November 2025 (prior to filing an amendment with East Whiteland Township) reflecting the amended project design they are currently seeking approval for, rather than the 2024 Plan previously approved by the Township. Specifically, the submission references shallow foundations, rather than the basements included in the 2024 Plan.

This raises a fundamental question: What plan is the developer currently constructing and obtaining permits to build?

Until the Township can confirm that the work being permitted and performed on the property is fully consistent with the currently approved 2024 Plan, I am requesting that the Township suspend the issuance and effectiveness of all permits issued for work not associated with the 2024 Plan and halt work authorized by those permits.

At a minimum, I am requesting written confirmation of:
1. Whether the Township has received the required Aqua commitment letter for the approved 2024 Plan and, if so, a copy of that letter.
2. Whether Permit #B-2026-221 and all related permits were properly issued based on the requirements of East Whiteland ordinance in effect at the time of issuance and consistent with the approved 2024 Plan.
3. Which approved land development plan and plan revision supports the issuance of each currently issued permit.
4. Whether the construction and foundation design reflected in the EPA submission are consistent with the 2024 Plan.
5. What action the Township will take if permits were issued based upon an unapproved plan or design or without required documentation.

Given the questions surrounding the approved 2024 Plan and the permits currently allowing work to proceed, I believe this warrants immediate attention. Please confirm receipt of this email within 24 hours and provide an update regarding the Township’s review and intended action.

Next I will load in all of the various things from people’s FOIA requests to the EPA that I have seen. They are not my work product. These are the residents who are amazeballs. I am only publishing what they received which is public. I would like to know where is the contaminated soil going? 2 stories approved plan drawing states 3 stories (includes basement)?? The approved plan requires them to excavate and move 5,000,000 cubic feet of contaminated soil- their number???Actually there are so many questions, all of or heads are spinning as to why in the Sam Hell is this still a project?

The residents of East Whiteland are on fire. They are amazing. I am in awe.

After the July 8, 2026 meeting, I reached out to East Whiteland Township because part of the audio at different points in the meeting once again disappeared.

Yesterday I reached out to them again, prompted by a snippet of a meeting that Ginny Kerslake had shared:

Ginny had said (and I quote):

I just noticed that the video East Whiteland Township posted of the July 8, 2026 board of supervisors meeting has almost a full minute, muted during which they were deliberating about the vote on the requested changes to the approved plan.

And yes, a lot of of us noticed that who were watching as a zoom participant. I thought maybe at the time it was just a problem with the live stream so then I went and listened to their recording and it was the same thing.

It was because of this, and the fact that one of the people they actually muted at that meeting, and it wasn’t the first time they’ve done this to her, was State Senator Katie Muth.

To be clear, so no one is confused, this was not an executive session where they would have left the room. This was deliberation in public, and the public has a right to hear it.

So I sent a follow up email yesterday that I will share:

I realize nobody wants to talk to me because I’m against the data center, however, I contacted you in good faith on July 9, 2026. It was about the live stream/zoom/recordings of the meetings being deliberately MUTED in spots.

I asked then about your tech guys who record the meetings. I had contacted you July 9th because I have concerns about the fact that it’s subverting the public record and against sunshine laws when they mute things or edit out sound.

It came up again in conversation and I am including an excerpt that Ginny Kerslake pulled where you guys are literally deliberating in public and then the video guys cut the sound. Deliberations in public are supposed to be audible and the sound was cut in the whole room unless you were physically sitting in the room, you heard nothing.

And it’s from the same meeting in July that I contacted you about initially. And they did it again at the recent August meeting.

If they can remove the audio, they should be able restore it and you really should have them do that. And you shouldn’t let them do this going forward because it is a violation of sunshine laws.

Also note that sometimes when they have done that, you’ve actually muted our State Senator Katie Muth. And that has happened in the boardroom in the Township building and one of the times where the meetings were at Penn State when somebody turned off the microphones or took them away. I would have to go look at the video to remember which it was but I remembered there were wireless microphones.

Others are included on this email because we were talking about it. Why we were talking about it is because I’m not the only one noticing it number one, and number two if you were going to have executive session, you would’ve left the boardroom right?

If you care to reference the Sunshine Act, it’s section 704. I probably shouldn’t have to tell you guys that partially muting a meeting can indeed violate the Sunshine Act because it prevents the public from hearing deliberations that are in public and it also restricts public participation.

As of 2022, cutting the audio or muting part of a meeting that is viewed/heard online or via other telecommunications (some people dial in versus zoom on a computer or tablet) disrupts open public access.

You have a right to reasonably control your meetings as far as maintaining order and time limits on public comment, BUT this other stuff? Selective censorship is something that flies in the face of transparency and the whole concept of open meetings.

It’s also quite frankly, not an example of good government. I am still waiting for a reply. Since I did not receive one on July 9 or shortly thereafter, I’m also assuming I will not receive any kind of a reply that is meaningful now because what will they say? That they weren’t subverting sunshine when they were?

My final comment is they have not been doing this for just this July meeting. It’s been going on for a while. They did it again at the August meeting.

Whatever happens in that room that is being recorded and streamed and done over a Zoom or other platforms live you are supposed to hear it all. We are not hearing it all. It’s not a wedding video, they aren’t wedding videographers. If they can remove the audio, they can put it back. And they can stop doing this in the future, but my guess is they won’t do it until someone challenges it vis-à-vis the sunshine laws. And I think you have 30 days after a meeting to do that.

meanwhile in north coventry

There was a data center meeting in North Coventry again last night. The developer came back again.

North Coventry Township KNEW this would be a big meeting but didn’t bother to find a bigger venue. Residents have told me they had 12 days to do so, but apparently did not? Residents were so immensely grateful for State Senator Katie Muth showing up for all of these residents, many of whom had to stand in a parking lot!

This not getting a venue that fits the crowd trick is getting old. East Whiteland has been doing this in my opinion. In East Whiteland they also alter the zoom video so even if you are on the zoom part of the meeting you can’t hear some of what is going on in the boardroom or on the recording post-meeting.

As a matter of fact I wrote to East Whiteland Township July 9, 2026 about this very thing of altering the sound that is actually subverting the public record is it not? Public meetings are supposed to be memorialized warts and all, correct? They have the often insipid meeting minutes for the sanitized life, right? Isn’t that as anti-sunshine as not getting a large enough meeting room when you know it will be a BIG meeting? When East Whiteland has done this in a few meetings they have actually muted State Senator Katie Muth. One time I think they turned off microphones, but the other times? The people they pay to record meetings deliberately mute out public reactions and that is wrong.

So in the end according to The Pottstown Mercury, the North Coventry Supervisors opposed the data center plan, but they need to address the fact that residents have a right to be at these meeting so they need to find a place to fit them in, not shut them out. After all up in Luzerne County, Salem Township is being sued by residents for doing just that.
