On February 19th, 2013 this blog broke the story of intolerable cruelty in West Vincent Township.  It was about the unwarranted shooting of two puppies named Argus & Fiona by a man named Gabe Pilotti in West Vincent Township. Since that time there has been much back and forth and legal hop scotch as people wait for a trial date so justice may be done the right way through our legal system.

This morning was supposed to have been the court date at the Chester County Courthouse in downtown West Chester, PA.  These were the charges levied back in February by the Chester County District Attorney’s Office:

But according to my sources, no court date took place earlier this morning.  (I am sick or I would have been at the courthouse, truthfully.)

The Bock family has suffered through the loss of their dogs and the ups and downs of the justice system, and I feel really badly for them and the memory of Argus & Fiona.  No one has asked for the sun, moon, or stars.  No one has condoned or asked for vigilante justice.  All anyone has asked for is that the justice system see this through and for lawmakers to consider strengthening dog laws in the Commonwealth of Pennsylvania so families and pets in this state not only have legal recourse, but laws that aren’t antiquated and might actually protect innocent pet owners and their domestic animals.

We’re still waiting.  And we want everyone to know we have not forgotten Argus & Fiona.  And neither should you.

I know that West Vincent Township would love everyone to forget about Argus  & Fiona because it happened in that warped Mayberry.  And like everything else that happens in West Vincent, it seems to be a bit of a hot mess still doesn’t it?  After all, why is it months ago when the charges were announced, why is it that West Vincent Township PD couldn’t confiscate one shotgun pending the outcome of the legal proceedings?

To all the wonderful people who have been supporting us and this fight for justice for Argus and Fiona, I wanted to give you a little update as to where we stand.  Because the defense has control over  the dates for court appearances, our initial main concern was having the gun removed from Pilotti’s possession….but because he has an “emotional attachment” to the gun it wasn’t that easy…..The DA suggested…that the gun be placed in a lock box at his neighbor’s house. The background checks were done on the neighbor and the gun was handed over….Sometimes it’s very hard to get any information…Thank you everyone for the continued support and all of your kind words

Again, I am not having a gun debate here (nor am I deliberately slamming or questioning the Chester County District Attorney’s office ) but I still fail to understand that since there has been a reckless endangerment charge pending why West Vincent didn’t pick up that gun and simply lock it up for safekeeping when those charges landed months ago? I have been told that is common practice when there are legal proceedings pending so I have always found this back and forth on what should be fairly cut and dry confusing.  I also do not get how you could have an emotional attachment to a shotgun, do you? I sure hope that West Vincent has periodically checked to see that this gun is in fact locked up  in this neighbor’s gun safe don’t you?

I do know that people in West Vincent are holding their breath still on this and let me be abundantly clear, I embrace responsible dog ownership just like I embrace responsible gun ownership.  I also respect the farmers’ rights to defend their livestock in crisis situation, but this was never a crisis situation because these puppies never attacked anything did they? I am also still at sixes and sevens as to whether or not Gabe Pilotti is actually a farmer or truly a hobbyist?  There is a difference.

I will also state again for the record that despising what Mr. Pilotti did in February is honest human emotion.  However I do not condone the behavior of people who stood in the middle of roads shouting with bullhorns or trespassed on people’s property or threatening him.  That is all wrong.

I post today to reaffirm that  people have not forgotten these poor dogs and what fate befell them and to remind lawmakers that they can’t just talk a good game when it comes to protecting our domestic pets like dogs.  They actually have to get off their duffs and DO something.  These pets aren’t property like an azalea bush or an ear of corn, they are part of our families. And since Argus & Fiona were shot to death we have heard of other cases of intolerable cruelty like this in Pennsylvania and other states.

Please contact your lawmakers again about Justice for Argus & Fiona and for changes to the dog laws and animal cruelty laws so animals are properly protected. I would also go as far as to suggest not only contacting your state elected officials (as in State Representatives and State Senators) but your U.S. Congressman as well for stronger Federal laws.  For most of us in Chester County, we are either served by Pat Meehan or Jim Gerlach.

And I really hope some day that Mr. Pilotti can express remorse to the Bocks eye to eye, don’t you? After all how will that man ever have peace in his own world without doing that?

I will close this post with a Buddhist prayer I find oddly apropos here today (yes I know not the norm you expect from a Catholic but never the less):

cluckThere has been a lot of discussion about “things” in West Vincent again, and once again the knee jerk reaction of someone is to post things which are tantamount to bullying at a minimum in a building that functions as a United States Post Office.

Posting harassing things to bully private citizens in a building designated a United States Post Office is like mailing the same things through the mail – it is not quite legal and that is why things like this are given to United States Postal inspectors, isn’t it?  Maybe it is past time to bump this up a notch?

So supporters, followers, politicians, township employees, whomever here is the 411: David Monteith is not and never has been “Chickenman”.  And Chickenman is not the one who started the inquiry into the problematic West Vincent Farmers Market.  Ordinary people did.  I have looked into it, does that make me Chickenman too?  Do the inconvenient facts that the Township Manager of Upper Uwchlan is following his zoning and the law make him , Cary Vargos , Chickenman?

I don’t know who Chickenman is and as an Auslander I stand a better chance of finding out than Ken Miller, Dave Brown, Claire Quinn and so on and so forth. Maybe Chickenman is Sam Cantrell and he is all organic? Maybe Ted Otteni or Gabe Pilotti is Chickenman?  What about West Vincent’s Township Manager and Township Solicitor? Are they in fact Chickenman?

I know David Monteith.  He runs a good business.  And because he stood up once upon a time in West Vincent he is harassed by supporters of “good government” as it currently stands in West Vincent.   These people stand in the shadows like vampires  afraid to be seen in daylight, don’t they?  And doesn’t this stuff oddly seem to happen to every other resident and taxpayer of West Vincent who stands up for the right things?  I figure it is only a matter of time before  John Jacobs and Maria Holderness will be targeted, right?  Maybe their residency will be challenged? How they tie their shoes? Maybe a case can be used against civilized, incorruptible, honest people some more in West Vincent?  Why does good = bad?

So are you going to attack me because I am sick of what you “good people” have been trying to do to an innocent man the past couple of years?  I get you are all working on mob mentality and like to hide in the shadows as bullies are wont to do, but sooner or later, probably sooner, you will be caught won’t you?  After all you never know where surveillance cameras lurk (other than in woods during private barbeques) do you?

The irony of this dumb as dirt thing posted today is the proposed farmers market for West Vincent is actually located in Upper Uwchlan .  So maybe Cary Vargo REALLY is Chickenman?  Hell maybe Jim Gerlach is Chickenman! Or what about that nasty Larry guy who left comments on this blog?  Is he Chickenman?

Lots of media follow this blog and eventually someone will say it is very odd the way West Vincent officials turn a seemingly blind eye while residents are bullied by government supporters.  And I bet that might include The Daily Local which some flannel mouth woman in West Vincent whose name begins with an “S” seems to think she controls, right? (I find that to be quite the accomplishment given she is neither editor, owner, nor publisher is she?)

If you people do not have the balls to come out of the shadows and man and woman up and have a conversation the right way maybe you should all just shut it?

But this bullying and harassing of private citizens who love where they live and want the best for residents IS going to stop. People get tired of it more and more every time. And the fact that May primary turned out the way it did and the fact that the placards in the United States Post Office are back says that someone or several someones are running scared and dare we say they are BIG CHICKENS?  Are they Chickenman????

Cluck, cluck, cluck.  This blog is my opinion as guaranteed by the founding fathers of this country via the First Amendment.  Guess they are Chickenmen too?

DSC_0210And I thought the drama surrounding farmers markets in my part of Chester County was enough.

Apparently not…..

Now there is more farmers market drama.  But what did I suspect? Or expect if it involves West Vincent Township? Shall we just call it Miller’s Market to go with the Miller Towers in Miller Township and be done with it?  Why in addition do the names Ann Marie Butera Cantrell and Sam Cantrell of Maysie’s Farm keep cropping up?  Are they the movers and the shakers who are behind the move to West Vincent from Anselma Mill? Is the Anselma Mill Market really moving from Anselma Mill to West Vincent or is the Anselma Market closing and another market opening in West Vincent? Are you able to track this because I am sure having a hard time….

So the drama with this market started when fans of the Anselma Mill’s Farmers’ and Artisans’ Market page on Facebook started seeing posts about that market closing and becoming the West Vincent Farmers Market.

It has been a veritable who’s on first scenario.  What is it about West Vincent that they can even (apparently) screw up a farmers market?  I love farmers markets and they are an awesome addition to communities but you have to do things properly.

And what is the craziest thing of all with this farmers market?  How about that the land proposed to be used might actually be in Upper Uwchlan Township?  So if so, has there been a meeting there?

Who is sponsoring this market?  Is it a local municipality?  Is it a non-profit farmers’ cooperative, and if so are they registered as a non-profit? Or is it a for profit business model, and if so who is it and will they be paying the right taxes and fees, etc?  Who will be responsible to the citizens of West Vincent (or Upper Uwchlan) in cleaning up the market? It is a little hinky on parking, so where will people park?

And who the heck ANNOUNCES a market as in signs, Facebook pages and so on and so forth that has not formerly been approved?  I mean what kind of amateur hour romper room antics is this? That just makes people resent something that should equal a pleasant experience, and of course that lends itself to asking again who exactly is doing this market?  And if it is a producers market that means all farmers have to grow what they sell right?

Seems to me there are a lot of questions and that this is something yet again that West Vincent is doing in a slap dash backroom deal kind of way, doesn’t it?  Is there actual permission in tangible form from Upper Uwhclan? And why was the legal notice SO LAST MINUTE?   Does the legal notice mean there is not quite the proper zoning for such an enterprise and if so who announces a farmers market with signs and Facebook pages if they don’t have the zoning in place?

What a shame is what I say.  Farmers Markets are awesome for local economies…but when you don’t do things the right way, can it be said everyone suffers?

Farmers Market drama is so unnecessary.  Sigh…Bravo could add a new series to their reality TV roster: “The Real Farmers Markets of Chester County“….

West Vincent Township has been actively working to bring a Farmer’s Market to the township’s Andrew Evans Park.  Local farmer Sam Cantrell came to a township meeting on March 11, 2013 to request the use of the Township property.

There was a question pertaining to the park property being eased against commercial activity and Clare Quinn stated that there is no easement. It was supposed to be eased as part of the DONATION to the Township, but it was never done. While Clare Quinn answered truthfully, the Township did indeed adopt a resolution AGAINST commercial activity on the property that stands today.

The township eventually elected against using most of the park, but there is just over 2 acres next to Rte 401 that the township purchased from Newt Evans and is allegedly not part of the resolution. The part of the park is actually located in UPPER UWCHLAN TOWNSHIP. There are some improvements that need to be made. In the last couple weeks, a pipe was installed in order to cross a drainage swale. Surveyors have been hustling around the location in the last week. I see signs have been popping up.

 

 

This operation has NOT YET BEEN APPROVED. Who is paying for these improvements? You are. Sustainability is a buzzword in West Vincent Township. Does Sustainability mean that the taxpayer need to underwrite the expenses of the local farmers?

 

Wait! It will be more than Farmers. It may be crafters, also. Here is the Farmer’s Market Facebook page: https://www.facebook.com/WestVincentFarmersMarket  this operation is required to be approved by the township of Upper Uwchlan and according to the video, a permit was issued (according to Ken Miller), against the zoning of Upper Uwchlan Township. Is Upper Uwchlan is starting to become like West Vincent by ignoring their laws? Did they really issue a permit? I urge everyone to watch these videos.  In Part 1, resident Frances Ellis points out that the use does not meet the criteria set forth in Upper Uwchlan zoning. In Part 2, Ken Miller is anxious to vote on this issue. The issue is discussed as if it has already been approved. Ken Miller becomes very upset when counsel advises against voting on the Farmer’s Market. It sure seems like this is a done deal, in the face of questioning that this clearly does not meet Upper Uwchlan Zoning.

What is the rush? Ken Miller needs a new outlet for his goods? This is his chance to move into a Farmer’s Market at no or little cost, at least to him. There will be plenty of cost to the township taxpayer as this moves forward. I am not against a Farmer’s Market, I think they are great. But it has to be a legal operation. Pearl’s Farm Market was shut down years ago because it’s location on Rte. 100 at Horseshoe Trail did not meet zoning.

 

Additionally,  why does the government (the taxpayer) have to finance someone else’s business? Rent the property, cover the expenses for ALL the improvements and costs. I have not seen any township video discussing how the township expenses are going to be covered. Better yet, do it on private property, where the rental income can be taxed, which supports the government operations.

There is a special township meeting currently advertised for Monday night, June 3 at 8:00 pm, (see attached), to vote on the Farmer’s Market. If you want to find out what the meeting is about, or just wish to be aware of what’s happening, you should attend.  But I bet I know how it will turn out.

it’s not easy being green….

It’s not easy being green…poor, poor West Vincent Township.  So much darn odd stuff happens within the township boundaries, you just can’t make it up.

The latest is a gargantuan pot bust.  Yes marijuana is apparently the new crop in that part of Chester County.  I can’t see it from my window and that is good.

Before I post the article I would mention that West Vincent residents have an AWESOME and not connected to the current regime candidate for supervisor – John Jacobs.  Given the odd things that happen to West Vincent residents  have an interest in cleaning up local government, can it be said this man puts himself at great risk to run?  Well of he can do that, you all should be able to vote for him.  West Vincent residents all say they want change, well the only way to get that is to break the death grip the current network has with a new supervisor.

You want change, people?  Vote the old out and vote in the new.  John Jacobs has a website.   Here is a link to other endorsed candidates if you are interested. Yes it is GOP and I would put up the Democratic info if I could find it. But the truth is who is representative of them in West Vincent? Clare Quinn?  Lordy that isn’t something to brag about and are you all still paying her benefits? Also worth noting? Another fabulous upstanding and honest person that I think would be marvy is running for West Vincent Township Auditor – Maria Holderness. Seriously people, it is time for change in your neck of the woods. After all what does it hurt to consider people whose hands AREN’T in some cookie jar somewhere?

WEST VINCENT — Over 180 marijuana plants were seized and one man was arrested Tuesday after police discovered a “sophisticated” grow operation at a home in the 1200 block of Jaine Lane in Spring City.

“Chester County District Attorney Tom Hogan announced the arrest of Christian Titone of Spring City Thursday for allegedly running what police said was a sophisticated hydroponic grow operation and that housed over 180 live marijuana plants .”;
According to the Chester County District Attorney’s Office, 53-year-old Christian Titone was arrested after police executed a search warrant at his home. Officials said the home was located in a secluded area of the township.

“Chester County District Attorney Tom Hogan announced the arrest of Christian Titone of Spring City Thursday for allegedly running what police said was a sophisticated hydroponic grow operation and that housed over 180 live marijuana plants .”;
“The defendant thought he could outsmart the police trying to grow marijuana in a secluded section of Chester County. He was wrong,” said District Attorney Tom Hogan. “We have confiscated his drugs arrested him, and now will move to forfeit everything associated with his drug dealing.”

“A large number of grow lights removed from the West Vincent home of Christian Titone, who is charged with a large-scale marijuana growing operation.

Police said investigators executed a search warrant at Titone’s home during Tuesday’s early morning hours. Inside, they found a sophisticated hydroponic grow operation…also found processed marijuana ready for sale…Titone’s home also had a “state of the art” surveillance system…After the search, executed by the Chester County Detectives and the county’s High Intensity Drug Trafficking Area Strike Force, members of the state police’s Clandestine Laboratory Team removed the marijuana and all of the growing equipment, officials said.

I notice the Daily Local lists a rather long list of law enforcement involved.  Basically everyone except West Vincent’s own police department and why?  Was West Vincent’s Chief out collecting Gabe Pilotti’s gun or something?  Pilotti is the one who shot the dogs in cold blood, remember?   One would have thought that the West Vincent police would have confiscated the weapon pending the outcome of the court case, right?  But we’re not here to discuss dog killers today.

Anyway just chalk it up to more unpleasant spotlights shining down on West Vincent.

Chester County detectives have arrested a West Vincent man who, they say, was  running “a major marijuana grow operation” in his house.

On Tuesday evening, detectives entered the home of Christian Titone, 54, on a  search warrant. Inside, they found 188 marijuana plants — part of what Chester  County prosecutors called a “sophisticated hydroponic grow operation” that  included lights, ventilation and an irrigation system, according to court  documents.

Authorities said an alleged marijuana grower thought his remote location and sophisticated surveillance system would protect him from police….“A high-tech, high-end drug operation like this would be providing drugs to suppliers from Phoenixville to Kennett Square and points beyond,” said Hogan….Titone has been charged with several drug-dealing offenses, including possession with the intent to distribute controlled substances and possession of drug paraphernalia, the criminal complaint said.  Hogan said Titone was released after “promptly” paying $100,000 cash bail. He said a preliminary hearing would be scheduled in the near future.

UPDATE  3.27.13 11:33 a.m:   *UPDATE* Tom Hickey from DogPAC just called.  He says that his sources have told him the hearing is STILL on for Pilotti (Argus & Fiona) 3 pm at 1130 Ridge Rd in Pottstown, PA.  He asks that if you are able to come show support, to please do so in a peacable manner.  No one expects this hearing to last more than five minutes – it will undoubtedly get waived to county court.  But apparently, he does have to appear. This is all we know and what we have been told.

UPDATE 3.27.13 10:08 a.m.:   Greetings – this morning greets everyone who want justice for Argus & Fiona with confusion.  Some sources say Pilotti has waived his hearing so there is nothing today, other sources say everything is moving dates again.  So the long and short of it is, we just don’t know.  We will update when we do.  Sorry to put folks in a holding pattern.  We appreciate your support.

UPDATE 7:40 P.M. (and note this is a moving target so who knows if it will move again or not):

Tom Hickey from DogPAC was kind enough to connect and tell us the hearing date had indeed changed….to TOMORROW. YES ANOTHER CHANGE TOMORROW (Wednesday, March 27th) at 3 p.m . If you can be there to show your support, THANK YOU. You know , they can keep changing it and we will still come, 1130 Ridge Road Pottstown, PA 19465  Justice, Love and Change ~ Argus and Fiona ♥ spread the word!  And VERY important – out of respect to the dogs and the Bock family, if you go tomorrow, PLEASE just bear witness quietly and show support.  No drama or the dogs will lose out. It is my belief this district justice doesn’t want this in his court, but I could be wrong.

EARLIER:

I feel a bit like a puppy chasing it’s tail this morning.  It seems that Justice for Argus & Fiona is not going to be so simple after all. We are hearing that the court date for Commonwealth v. Pilotti has been moved….again….we are hearing 3/28/2013 at 8:30 a.m. (We are waiting for media and other sources to confirm this 100% but that is what a law enforcement source has said.)

If you refer to the official court docket you will see that the date of the hearing in the court room of Magisterial District Judge James V. Deangelo has been moving about like a game of Chinese Checkers.  The original hearing was 3/28/13 at 9 am.  Then it was 4/4/2013 at 9 a.m. and then it was 4/4/2013 at 1 p.m. However on another docket most people never click on called the Public Court Summary is says “Next Action Date: 03/28/2013”

So we now have ANOTHER change that the court will neither confirm or deny: that the trial is BACK to 3/28/2013 or this THURSDAY as in the day before Good Friday and Easter Weekend.

I have to ask why this court date and the times are  moving at such an extraordinary rate.  Is this a ploy on the part of the defense, a/k/a Gabe Pilotti’s lawyer?  Or is it because the District Justice Court in Pottstown  keeps moving the date to avoid a media spotlight and crowds of Justice for Argus & Fiona supporters? Do the officials elected or otherwise in West Vincent have anything to do with this?

I want to remain calm, cool and collected and avoid conspiracy theories, but I have to tell you when you have VERY reliable sources telling you the D.A.’s office in Chester County is telling THEM the date is the 28th of March again or this Thursday as in two days from now, yet when I call out to the court and speak to a lovely woman named Rebecca who asks me how I heard this because (and I quote) “It is not the 28th…nothing formally has been changed…but you can check the docket later.” well it is darn frustrating.

So it seems to me something more is afoot.  I can’t help but think someone is trying to sneak something past everyone AND the poor Bock family who have a right to their day in court for their beloved pets.

Regional and local media, you have been so incredibly generous in your coverage of this issue.  We hope you can see all this Tom Foolery over the magically moving court date will encourage you to resume coverage.   After all, will justice be so thorough without the eyes of the region upon her?

Supporters of dog issues please watch the court dockets too.  Apparently it is going to take more than a village to get justice after all.

argus & fiona’s laws? can we do that?

DSC_0105I woke up thinking of the laws that need to change, and in my mind a bunch of things need to happen:

  1. Punishment AND fines for animal cruelty need to be tougher all the way around.  It needs to mean more than an inconvenience
  2. Pennsylvania as in the Commonwealth needs to recognize companion animals like dogs as more than property- people discussed that a few years ago when trying for stiffer puppy mill laws but I do not recall anything than some stuff getting watered down. I bet Tom Hickey from the state is watching this blog, and I would like him to connect with me.
  3. Also farm statutes must be updated so there is less “fuzzy” area. My thought is two-fold: protect the dog owners better, but still give farmers recourse. I have not fleshed that thought out anymore than that but in PA we need to remember the importance of farms as they do drive enough of state economy still.
  4. I believe that municipalities like West Vincent that used to be extremely rural need to be made to look at their zoning more closely.  After all, when you get down to it development doesn’t happen without them does it? So it is incumbent upon them to work harder for better relationships between old and new.  Also what defines a farmer versus a hobbyist with tax breaks?
  5. Gun and gaming laws. I do not want this tragedy to be overshadowed and used by a national political debate. My frame of reference is simple: school people on existing laws because one of the things so irresponsible about what happened is the fact a shotgun was discharged like that in what I am told is R2 residential as opposed to land area zoned agricultural and am I wrong in that?

argus and fionaState Senator Andy Dinniman who represents a lot of us and is a huge animal advocate is working on some law having to do with dog owners being able to sue for damages.  He says and I quote ” I am drafting a law that would allow pet owners to civilly sue those who harm or kill their pets.”  I do not know the specifics other than that but would ask that if some of his staff is watching this blog if they could  post specifics as they occur.

I urge you to contact your lawmakers on a state and federal level and ask for change that will protect our dogs better. They are a part of our families not like an ear of corn.

Together if we focus together and ask for Justice for Argus & Fiona, maybe we can propel that forward to someday mean Argus & Fiona’s Laws.

I will also comment briefly that in spite of media spin the Facebook page Justice for Argus & Fiona , it was set up with a peaceable goal of true justice.  As in through the legal system, including changing laws to better protect dogs.

After all, one of the people who helped set up the Facebook page was Mary Bock, who is a truly lovely and gentle woman who has shown such grace and peace in the face of unbelievable family tragedy.   Make no misunderstanding with regard to that page as it is not for deviant purposes and  implication is resented. People are banned and comments are removed. Posting and commenting is a privilege, not a right.

However, the unfortunate reality is that in this world two of the most heated topics in the world are issues having to do with children and pets, and this issue involves BOTH.

Below are some media snippets from yesterday afternoon as the region learned the dogs would start to have justice, and did not die in vain.  I will comment that I am struggling with the statement Mr. Pilotti is purported to have released about remorse and prayers for the family.  Part of me hopes it is true, yet part of me wonders why he simply did not do that before the media and public got news of what happened?  Correct me if I am wrong, but didn’t he have almost a week in between the actual date of tragedy and media whirlwind to pray and show remorse?

In any event, those of us supporting the Bock family do not support violence.  Nor do we support nut jobs that stand outside anyone’s home screaming anything. No matter WHAT has transpired, we as a society cannot swirl downwards into utter lawlessness.  More bad acts will not solve any issue.

So I ask all of you to use your energy to speak out for dogs.  Get laws changed.  And oh yes, no matter what West Vincent says if you live there you have a right to be heard at the Supervisors meeting.  They may decline comment, but you have the right to public privilege of the floor or public comment.  They do not have to respond, but as elected and appointed officials part of their job is to listen. Just be polite.

argus and fionaNow personally, I think the Chester County District Attorney’s Office should be thanking all of us for bringing the topic to their attention, and to thank the lawyers not involved who suggested that there was more to be looked at, but I will take gladly these baby steps towards justice as per below press release. Someone said to me the political translation loosely was: West Vincent was hog tied and couldn’t make it go away but even I don’t want to be that mean. – they after all have proven cruelty to chickens, right?  (HINT to West Vincent: treat your residents with respect at the upcoming meeting on Monday, they have a right to be heard.)

The charges filed by the DA seem to be animal cruelty and reckless endangerment.

But there is more to do, and laws to be changed.   So can we work together on this so Pennsylvania dogs are safe from harm like this?

Please write or Facebook or call your elected officials today.  Let them know that we want Justice for Argus & Fiona and other dogs who have suffered needlessly and tragically like and before them.

dogsWhen I saw a post on a friend’s Facebook wall this evening from one of their friends, I had to read it half a dozen times to make sure I wasn’t reading incorrectly. When I read what I read I started to cry, and also thought I would throw up. It was Just. That. Awful.

I have to ask why these things happen in West Vincent Township? I am told this occurred in West Vincent Township within the last week?  This is crazy and it is sick and this guy shooting up dogs should not be able to hide behind antiquated farming statutes.

Do we really believe this guy with the gun doesn’t know his neighbors’ dogs?  Do we believe that he really gave these dogs a chance? Can it be said if he had, they would be with their humans?

I am generally speaking a big supporter of farmers, and I get how farmers do not want livestock worried in a field. The thing is this: if you are a farmer or are dog saavy you know when a dog is herding, playing, or attacking.

Oh and here is a voicemail left for a neighbor (who turned this over to grieving family and police apparently) by the dog shooter:

I just don’t believe this farmer guy did not have any options other than to gun down two dogs who could still be considered puppies. The family knows nothing can bring back these beloved pets.  But they do feel there should be some accountability – the wife said to me in a note:

[We] know that nothing will bring our pups back, but if we could save another family from having to go through this, we would do anything. This man will do this again, I know this in my heart.  He is using this law as justification and is showing absolutely no remorse

These people have little kids.  How the heck do you tell little kids their neighbor shot their beloved dogs? And yes I get there are laws designed to protect farmers, but most of the farmers I know wouldn’t just shoot puppies.  They might round up the dogs and turn them over to animal control for return to their families but they wouldn’t just gun down a neighbor’s pets.

My heart bleeds for these people.  I think West Vincent resdients should bring this up in person at the next township meeting. I think the media should investigate. I think the Chester County SPCA and Humane Society should investigate.

2.20.2013 UPDATE:

I am told by sources that the Chester County SPCA is going out to investigate today?  Here is hoping they check things out thoroughly.  Sources tell me this guy really isn’t much of a farmer that the sheep mostly keep his lawn cut?  Also if this guy is in a R2 (think that is the residential zone) in West Vincent, does he legally have enough acres to keep farm animals/livestock which is what sheep are?  If his acreage with the amassed lots he owns is under 10 acres how does that work?  I mean out there you must have a minimum of 2 acres to keep one horse for personal use, right? But farm animals are different and how many years has this guy had sheep?  I ask because is it not true if he does NOT have the correct acreage he could be in violation of current zoning and prior to the 2010 revisions as well? Are all his grazing or “pasture” areas fenced in? Is he connected over there or something?  Also, if this guy is in a residential zone, is he compliant with PA gaming laws in a residential area with regard to the safety zone for discharging rifles and shot guns?

I had more farmers contact me today.  Some who were very amusing to me because they scoffed at the idea of this guy really being a farmer. (I don’t know so I leave it up to the experts as it were.)  Including one who said he had to shoot a feral dog years ago because it mauled and killed two of his sheep – he said he hated to do it, but in that case the dog was wild and was caught in the act.  This farmer said to me if he had seen these dog he would have maybe fired a warning shot, but most likely he would have plunked them in a stall in his barn and called the police to return the dogs to the owners with a warning.

I found a reference to PA law below – not a lawyer, not sure if it applies, but read it:

Safety zones – 34 Pa. Cons. Stat. § 2505

§ 2505.  Safety zones.
(a)  General rule.–Except as otherwise provided in this
title or to any political subdivision, its employees or agents,
which has a valid deer control permit issued under section
2902(c) (relating to general categories of permits), it is
unlawful for any person, other than the lawful occupant, while
hunting game or wildlife, taking furbearers of any kind, or
pursuing any other privilege granted by this title, to hunt for,
take, trap, pursue, disturb or otherwise chase any game or
wildlife or to discharge, for any reason, any firearm, arrow or
other deadly weapon within or through a safety zone, or to shoot
at any game or wildlife while it is within the safety zone
without the specific advance permission of the lawful occupant
thereof.
(b)  Penalty.–A violation of this section is a summary
offense punishable by a fine of not less than $200 nor more than
$500. A second or subsequent offense within two calendar years
is a summary offense punishable by a fine of not less than $500
nor more than $1,000.
(c)  Definition.–As used in this section, the term “safety
zone” means:
(1)  Except as otherwise provided in paragraph (2), the
area within 150 yards around and that area which is below the
highest point of any occupied dwelling house, residence, or
other building or camp occupied by human beings, or any barn,
stable, or other building used in connection therewith or any
attached or detached playground of any school, nursery school
or day-care center.
(2)  When applied to properly licensed persons hunting
with bow and arrow or crossbow, the area within 50 yards
around and that area which is below the highest point of any
occupied dwelling house, residence or other building or camp
occupied by human beings or any barn, stable or other
building used in connection therewith and the area within 150
yards around and that area which is below the highest point
of any attached or detached playground of any school, nursery
school or day-care center.

So this Bing image shows how residential this is, right?  Maybe Chester CountyDA needs to look at discharge of weapons in R2 zone ? Do you all not see
numerous dwellings that *possibly* could be well within the 450 ft gun safety zone?  I am told the area where he keeps the sheep is fenced, but in poor repair, with a section patched with plastic garden fence? If dogs as big as sheep can get in, sheep can get out, right?  Again, is he possibly in potential violation of zoning and gun laws?  Pine Drive is the first development approved in WVT in the late 60’s or early 70’s, correct?Isn’t it the only development ever approved with 1 ACRE LOTS?  So what about that safety zone in the entire residential development and discharging a weapon? Guns are a hot nationwide topic are they not?  Even in PA?

Chester County residents, do you want the entire county to look like this?  Didn’t some of you move out here to escape this in the first place? Can you now shudder at what that old DuPont Estate will look like?  Can you imagine what that next  Appledumb, Mountainfake, Potters Field, and Byers Remorse will look like? (Can’t keep track of all the municipalities and doofy names of developments or developers so pardon the comedic license.)

DSC_0069The problem with small towns is among other things, gossip.  Can that be said to be a huge issue in West Vincent Township?

As an auslander observing how these small Chester County Hamlets like West Vincent work, it can often be described as with fear and loathing can’t it? He said, she said with an unhealthy dose of incestuous politics, right?

So many I know would never live in West Vincent because of the convenient and batting of the eye inexplicable crap that happens to ordinary people who aren’t even doing anything half the time, right?

Want to know what I have noticed going through West Vincent of late?  The number of properties for sale on every road and dirt lane imaginable.  It is a small place and it seems that in it and abutting it, homes are going up for sale.  Some of them incredibly beautiful, slice of heaven worthy properties. Can that all be because of the economy?  Or is it deeper, darker, more sinister?  Could part of what is wrong also have to do with fears of unecessary development? (see letter here called 2February2013Bville ) Or taxes? Or how tax monies are spent? Township services?

But part and parcel of what is wrong with West Vincent is fear and loathing and whisper down the lane, correct? Political retribution?  Persecution of innocents?

Bullies come in all shapes, sizes, ages, and socio-economic levels.  Real Christian people abhor bullying.

So West Vincent officials of course you know nothing about this, right? But can it be said you might never lift a finger if you knew who was doing this?

So West Vincent, here is the 411: Do you want to be on my radar again?  Do you want to be under the microscope of media? 

We realize you are still obsessed and live in fear of Chickens and mobs of Birchrunville People but let’s grow up, shall we?  Not every one of your residents is going to agree with you.  You are not gods.  You were put there by the people and can be removed by the people, yes?  You are not immune to ethics inquiries and state investigations, either, are you?  Is that what you are trying to avoid?

The times they are a changing and it is time for twisted Mayberry to get with the program. Persecution and gossip are so Salem Witch Trials and February 1692 right?

And here is an idea to lay on the general public: accountability.  If you know who leaves persecution missives around town in this country hamlet, feel freee to speak up.  God don’t like ugly after all.

A final thought to file under God don’t like ugly and accountability are some flyers I have held onto, and in some cases for months.  People have been sending them to me for months.  They show up in places like the US Post Office in a couple of locations.  I believe Birchrunville and maybe Chester Springs.

It is of course damn stupid to harass private citizens via the US Postal Service – and FYI it doesn’t matter if you are posting on post office property or sending through the mail it can and all should be given to US Postal Inspectors, shouldn’t it?  They throw stuff like that through crime labs for prints and whatnot – sometimes state labs, but often Federal labs and would you want YOUR finger prints or DNA on them? And this isn’t CSI, they actually do this stuff. And if my name was on one of those flyers being left in post offices I certainly would contact the postal inspectors.

I have redacted the names but it is all obviously political in West Vincent because the citizen targets include one person who ran for supervisor and someone else was an honest Republican Committeeman.  And the type face  and phrasing is similar enough to give anyone with a brain pause that it is the same author or authoress as the notice above. But again, anyone with a brain wouldn’t do something this stupid because eventually it all comes out. And these people are doing this because they are obsessed with Chickenman.  As in who the writer Chickenman is.

And what are they going to “prosecute” Chickenman for anyway?  Telling the truth? (In that case Viva La Chicken, right?)Having First Amendment Rights? Exercising a very American tradition of having a pen name? (I will also note they tried this a few years ago in Delaware County with a blogger called Delco Tom Paine or something close to that.  He was never exposed, never prosecuted, and much of what he wrote about came to pass.)

Bottom line: government corruption is like mold until it sees the light of day.  And shame on whomever for persecuting private citizens for having two brain cells to rub together. And if these flyers end up being discovered as being created by West Vincent elected officials, appointed officials or with the knowledge of either well that might be a problem for a lot of people, huh?

West Vincent, it is 2013.  Knock it off.  The more you try to slide stuff by the more people seem to come forward and ask questions.  Trying to silence, bully, harass, initimidate, and harrangue residents is not working in your favor so why not try a little honesty instead of croneyism?
